  • Desertion
  • Physical Cruelty
  • Habitual Drunkenness

1.

Child Custody and Visitation

One of the most heart-wrenching" difficult decisions for parents going through a divorce is resolving child custody and visitation issues. Child custody refers to how much time each parent will spend with their child" and whether they can make decisions for them. According to South Carolina law" child custody and visitation time are based on what is best for the child.

 Personal Injury Attorney Bluffton, SC
2.

Child Support

Like other U.S states" a formula is used in South Carolina to determine how much child support a person must pay. This formula recommends the amount of child support based on factors like how much income the parents make" the cost of childcare" and the obligation to support children from other relationships.

3.

Alimony

In South Carolina" there is no formula to determine how much alimony a person must pay. However" courts consider several factors when deciding if alimony is needed" how much alimony should be paid" and how long a spouse must pay it. Those factors include each spouse's ability and need to pay alimony" how long the marriage lasted" and any marital misconduct that occurred. To make matters more confusing" there are different alimony types" including lump sum" rehabilitative" and reimbursement.

4.

Distribution of Property

In South Carolina" marital property is the property that each spouse amasses from the date of the wedding to the time a spouse files for divorce. That property can often include marital debt. In a South Carolina divorce" the courts will order an equitable division of property" meaning "fair" under all circumstances but not necessarily equal.

Understanding Child Custody in Bluffton" SC

As mentioned above" decisions that involve child custody and visitation can be contentious for parents" both emotionally and legally. As experienced" empathetic divorce lawyers" we understand how difficult this process can be. When we work with clients going through child custody battles" we always make it a point to be with them through the ups and downs" to help them stay centered. Whether you are the husband or wife in your divorce" we share a common goal: finding an effective way to support your children and assure their wellbeing.

In South Carolina" child custody is a loaded term. In the most general definition" child custody determines when each parent is responsible for the physical care of the child and how much authority each parent has" to make decisions in their child's life.

No two child custody cases are the same" but a negotiated custody arrangement is usually preferred in the judge's eyes" as each parent has input in the process. If the parents cannot come to an amicable resolution" their fate is left in the hands of a Family Court Judge in South Carolina. The focus of child custody law is always on what is in the "best interests" of the child. What the judge determines to be the "best interests" changes depending on the judge.

There are different variations of "custody" in South Carolina (or custody arrangements)" each with varying degrees of authority. When you consult with our family law attorneys at Cobb Dill & Hammett" LLC" we will go over the child custody process in detail and touch on each distinction to eliminate any confusion you have.

  • Help develop cooperative solutions to disputes or mediate when needed
  • Create an equitable parenting plan
  • Discuss the implications of the different forms of joint and sole custody
  • Problems related to child support
  • Modify court orders if you or your child's circumstances change

in Bluffton" SC

  • Cases where child support is needed for stay-at-home parents

  • the mediated route often means less stress and is more cost-effective than trial.

Understanding Division of
Property in Bluffton" SC

When there are no children" marital property" or issues of alimony" divorces often proceed smoothly between amicable spouses. However" most divorces in South Carolina are much more complex. Typically" divorce involves a union between spouses that lasts for years and involves substantial marital property. This property can be personal property" real estate" family businesses" debts" out-of-state property" debts" bank accounts" and more.

In these nuanced situations" the applicable parties need assistance dividing their property. This help most often comes from seasoned family law attorneys like Cobb Dill & Hammett" LLC.

When it comes to distribution of property" certain types of properties that are controversial" even under the property division rules in South Carolina. South Carolina is an equitable distribution state" meaning that marital property is divided equitably but not always equally.

If you are going through a divorce" it's important that you are aware of the following assets and the common issues their division presents:

 Estate Planning Lawyer Bluffton, SC
Pensions

Pensions:

Generally" pensions are the second-largest asset in a marriage. When there are sufficient alternative income sources to compensate the non-pension holder" South Carolina divorce courts may leave the pension rights with the spouse who earned it" with future distribution available. Otherwise" a divorce court may enter a Qualified Domestic Relations Order requiring the pension administrator to pay both the former spouse and worker.

Family Home

Family Home:

The family home" or the primary residential property owned by the divorcing couple" is usually considered a marriage's biggest asset. Dividing this kind of property can be complex and frustrating" especially when there are kids involved.

Many divorcing couples have a hard time reaching an agreement on property division. Because the division of property depends on the complexity of you or your spouse's assets and liabilities" it is crucial to consult with an experienced family law attorney to provide guidance.

Bluffton fans of Island Nutrition and Okatie Nutrition won’t have to drive as far for the business’ shakes and teas.

The owners have opened a third location — they’re calling this one LoCo Nutrition — in the Shoppes at Myrtle Park shopping center at Bluffton Parkway and Burnt Church Road.

In January, Melonie Hackman and Doug Rounds took possession of the storefront in the plaza that also is home to Planet Fitness, but they were not able to start construction for several months. They are still waiting on some finishing touches, including a sign for the front.

LoCo Nutrition opened May 29.

“We are so excited about this location,” Hackman said. “It’s something our customers have been asking for.”

Island Nutrition opened on Hilton Head in November of 2020, and Okatie Nutrition in Riverwalk Business Park quickly followed in June 2021.

The Bluffton location will offer the same basic menu of Herbalife-branded shakes and teas but also will include pre-workout and post-workout options.

“That’s brand new for us,” Hackman said about the new “Fuel Your Workout” menu.

A grand opening will be scheduled in the next few weeks.

Hackman said fans should follow the shops’ Instagram and Facebook pages for information about hours and daily specials for LoCo Nutrition’s shake and tea combos.

“Ordering two drinks together is a different idea for some people,” Hackman previously told The Island Packet. “But it’s like when you go into any other restaurant and order a meal and a drink. The shake has the nutrition of the meal while the tea is your drink.”

There are dozens of different flavors of shakes, each with 24 grams of protein and about 250 calories. They are made to be energizing, metabolism-boosting and calorie-burning. If tea isn’t your thing, there are coffee options on the menu, and coffee-flavored shakes as well.

What: LoCo Nutrition

Where: 48 Burnt Church Road, Suite 200A

Hours: 7 a.m. to 6 p.m. Monday through Friday; 10 a.m. to 4 p.m. Saturday and Sunday

BLUFFTON, S.C. (WSAV) – A lamb on the loose for several days in a Bluffton community is now safe and sound.

Kelly Housaman said she was driving around Hampton Hall Club on Monday when she came across a sheep snacking on someone’s lawn.

“Another couple who had also spotted it drove up on their golf cart and showed me a video of the sheep swimming in the lagoon with two gators coming after it,” she said.

Housaman said she and the couple quietly followed the sheep through neighbors’ backyards. At one point, she found herself crouched down near a lagoon.

“About 2 feet away from me is another giant gator,” Housaman recalled. “All I can think is, ‘Please don’t make me gator bait while chasing this sheep.'”

The alligator kept its distance but Housaman said a solid hour passed before the lamb ran into the woods, ending the search for the day.

The next morning, Hampton Hall’s tennis director Paul Tollefson encountered the lamb. While he’d come across some wildlife before on the job (an armadillo included), this sheep was a first.

“I’d seen people talking about it,” he explained. “It chewed through the rope that it was tied to, most likely from a neighboring piece of land outside of the neighborhood.”

When he got to work Tuesday morning, Tollefson said he saw the lamb charging at a woman who was walking her two golden retrievers.

“Not sure if it was trying to play or what. The old lady was scared to death that her dogs were going to attack it. I tried to use my best sheep whispering, to no avail,” he laughed.

Instead, Tollefson asked the woman to walk her dogs inside the gated tennis court so the lamb would follow.

Sure enough, that did the trick.

“If anyone can come catch it, I got him fenced in,” Tollefson shared on Facebook.

“I dropped my kids off at school and rushed over there,” Housaman said. Meanwhile, Beaufort County Animal Services was en route.

Housaman said she was able to corner the sheep with the help of another resident, a security guard and Tallulah Trice, director of Animal Services.

“The sheep made a last-ditch leap and I caught the rope on my hand and grabbed him,” Housaman said. “He was pretty tuckered out at this point and allowed me to straddle him to keep him still while [Trice] grabbed her big carrier.”

She sealed her two-day-long lamb hunt with a selfie.

  • It’s believed the lamb is either a Cotswold or Dorset breed and had been on the run for six days. Trice said in a situation like this, it’s likely the rightful owner won’t come forward for the animal.

“It happens more than people think,” Trice said.

Just last month on Lady’s Island, a bull was seen trotting through traffic after escaping from a nearby pasture.

In fact, the director has three goats and nine chickens of her own from other animal encounters across the county.

“We deal with this kind of stuff all the time,” Trice added.

    So where is the lamb?

Now named Poseidon, he’s taken residence at Edenhope Farms, an animal sanctuary/bed and breakfast on Marsh Drive.

Farm owner Cyndi Allison said Poseidon is fitting right in with the other animals — peacocks, chickens, cattle, ducks and her famous billy goat included.

    “He’s doing great,” Allison said.

Should you happen across any sheep roaming around your neighborhood, Beaufort County Animal Services can be reached at 843-255-5010.
