The word "estate" might make you think of a sprawling mansion in the French countryside. The truth is, you don't have to be rich to have an estate. In fact, most people already have an estate. An estate comprises the assets that a person owns like cars, bank accounts, real estate, businesses, and other possessions. Everyone's estate is different, but we all have one thing in common: none of us can take our estates with us when we die. When that does eventually happen, you will need legal instructions that state who gets what from your estate in plain terms. That, in a nutshell, is estate planning â building a framework in advance that names the organizations or people that should receive your assets after you die. Planning your estate now helps make life much easier for your family down the line.
Contrary to popular belief, estate planning isn't just for adults who are approaching retirement age. Estate planning is for everyone. After all, we're all getting older, and none of us know exactly when it will be our time to go.
Although estate planning can be complicated, a well-rounded plan makes a huge difference in what is left to your beneficiaries. Before you start planning your estate, it's important to know a few common topics that may arise as you detail your needs.
Working with a veteran estate planning lawyer is a no-brainer, but you should consider working with a tax advisor too. Your attorney's role is to help guide you through the creation of your estate planning documents. Common documents include your will, health care directives, and power of attorney. Your tax advisor will help guide you through tax issues associated with your estate planning needs.
In this relationship, you make the decisions while your attorney and tax advisor help you understand and think through the options you're considering. As a team, they will help you state your wishes clearly while minimizing mistakes and adjusting your plans as they change. Because significant savings can result from thorough, informed planning, you should seriously consider working with a tax advisor in addition to your estate planning attorney.
If there were one overriding theme of estate planning, it would be maximizing what you plan to leave behind. Thinking through how each of your assets will be distributed is crucial to your estate. Your decisions may change depending on the type of asset, its size, how old you are, and several other factors. With an attorney on your side, you will gain a thorough understanding of what actions you should take to care for your family while minimizing expenses like taxes and court fees.
One of the biggest parts of maximizing what you're leaving behind is to minimize taxes. Federal taxes on estates and gifts are incredibly high. Both forms of taxes usually have exemption limits, which means you can give up to a specific amount without being taxed. Your lawyer can achieve that by using the gift tax exemption to move assets while you are still alive. This strategy maximizes how much your beneficiaries will receive.
Inheritance taxes are often based on the value of your estate and paid prior to asset distribution to your beneficiaries.
The executor of your estate plays a key role in your affairs. Their responsibilities include carrying out the terms of your will and seeing the estate settlement process through until the end. Obviously, such a role demands a qualified person. Choosing your executor isn't an easy decision. The person you select should be great at managing money, be savvy financially, and show an ability to be patient. That's because the executor is tasked with:
If the person that you choose as executor is inexperienced with the estate settlement process, it is recommended that they lean on an estate planning attorney in Greenville, SC for guidance. It should be noted that you may appoint more than a single executor to your estate. This is common when two individuals have complementary personalities or skill sets.
One of the biggest benefits of planning your estate is the peace of mind it brings to you and your family. With the help of our expert estate planning attorneys, you have the power to protect your assets, privacy, and children's welfare. You can also potentially save money on taxes or even avoid probate. By having your wishes legally documented before death or incapacity, you can minimize any impact on your beneficiaries and take control of your legacy. Without a comprehensive estate plan, you're leaving the future of your loved ones in the hands of the South Carolina court system.
With an estate plan in place, you can plan for incapacity by using a power of attorney or advanced medical directives. Doing so relieves your loved ones of the burden of asking the court for the authority to fulfill your wishes.
At CDH Law Firm, we are committed to helping you prepare for both the expected and unexpected through years of experience and a fierce dedication to our clients. From establishing trusts to designing business succession plans, we are here to fight for you.
If a husband and wife each purchase reciprocating will packages we give a discount. Reciprocating just means the husband names the wife and the wife names the husband. Those four documents are:
As mentioned above, everyone's estate planning needs will be different. However, most plans include one or more of the following documents:
Your will is an essential piece of documentation and is often considered the cornerstone of a proper estate plan. Generally speaking, your will is a document that dictates the distribution of your assets after your death. Having an iron-clad will is one of the best ways to make sure that your wishes are communicated clearly. As is the case with most estate planning, it is highly recommended that you work with an estate planning attorney in Greenville, SC, to create and update your will.
The contents of a will typically include:
Without a will in place, the State of South Carolina will decide how to distribute assets to your beneficiaries. Allowing the state to distribute your assets is often an unfavorable route to take, since the settlement process may not include what you had in mind for your survivors. Having a will drafted that reflects your wishes will prevent such a situation from happening.
Despite its name, a living will does not instruct your survivors on what assets go where. Also called an advanced directive, your living will allows you to state your end-of-life medical wishes if you have become unable to communicate. This important document provides guidance to family members and doctors and solidifies certain issues like whether you should be resuscitated after an accident.
For example, it's common to direct that palliative care (care to decrease pain and suffering) always be administered if needed. Conversely, you may state that certain measures are not allowed, like CPR.
Traditionally, a trust is used to minimize estate taxes and maximize other benefits as part of a well-rounded estate plan. This fiduciary agreement lets a trustee hold your assets on behalf of your beneficiaries. There are many ways to arrange a trust to specify when and how your assets are distributed.
With a trust in place, your beneficiaries can avoid going to probate. That means they may be able to gain access to your assets quicker than when they are transferred with a standard will. Assets placed in a trust can pass outside of probate, which will save you and your family time, money, and stress.
There are two distinct trust categories that you should be aware of: revocable and irrevocable.
Also called a living trust, a revocable trust helps assets circumvent probate. With this trust, you can control your assets while you are still alive. These trusts are flexible and may be dissolved at any point in time. This type of trust becomes irrevocable upon your death. Revocable trusts can help you avoid the pitfalls of probate but be aware that they are usually still taxable.
This kind of trust transfers assets out of your estate so that they are not taxed and do not have to go through probate. However, once an irrevocable trust has been executed, it may not be altered. That means that once you establish this kind of trust, you lose control of its assets and cannot dissolve the trust. If your primary goal is to avoid taxes on your estate, setting up an irrevocable could be a wise choice.
When drafted with the help of an estate planning lawyer in Greenville, SC, your trust can also:
When constructed properly, a trust can protect your estate from your heirs' creditors. This can be a huge relief for beneficiaries who might need to brush up on money management skills.
Probate records are made available for public consumption. With a trust, you may have the choice of having your assets pass outside of probate court so that they remain private. In the process, you may also save money that you would lose to taxes and court fees.
Because you can specify the exact terms of a trust, you have more control over who receives your assets and when they receive them. As an example, you can set up a revocable trust so that your assets are attainable while you're alive. When you pass, remaining assets are distributed, even in complex situations involving children from multiple marriages.
If you know that you need to provide for your family and loved ones after your death, it's time to develop your estate plan. With CDH Law Firm by your side, planning your estate doesn't have to be difficult. However, it does need to be accurate and executed exactly to your wishes â something that we have been helping clients achieve for years. Don't leave your legacy up to chance â contact our office today and secure your future generations.

Ever wish there was a playground for adults (in air conditioning)? Group Therapy Pub & Playground is now open in Greenville, SC and it’s exactly what you’re hoping for and more!
Sometimes you just need some space to chill out, play some games, and belt out some karaoke, or if you’re like me, just cheer on the brave souls who do. All of that and more is at the new Group Therapy Pub & Playground at Camperdown Plaza in downtown Greenville.
While the place is geared for grown-ups, they welcome families and kids during the day before 7 pm and they will certainly love the creative indoor miniature golf course, curling, and ping pong. And Group Therapy is ideal for date night as well. Group Therapy is basically like The Children’s Museum of the Upstate but for grownups.
There’s an entire 18-hole miniature golf course themed after movies like Jaws, Ghostbusters, E.T, and Jurassic Park. I loved this! It was so fun and creative and pretty much indestructible as you can ride the bike on the E.T. hole or pretend you’re the next victim of a T-Rex or Great White Shark. So fun!
If axe-throwing is more your speed, there are several bays to get out your aggression by chucking an axe at a wooden board. I had a blast trying this out even though I couldn’t even get the axes to stick on the board. It felt pretty good to throw sharp things though. You’ll get a safety lesson beforehand and you need to wear closed-toed shoes to participate in this activity.
If neither of those activities float your boat, you can play curling, ping pong, Jenga, or cornhole. There’s a lot to do at Group Therapy. They also have karaoke, trivia nights, and special events, which will be announced on their social media pages, website, and through their email newsletter.
The bar at Group Therapy serves up beer and cider on tap but also has a long wacky cocktails menu with drinks like Galaxy’s Edge and Blue Vortex. If the menu is too overwhelming for you, don’t worry because you can choose the “Trustfall” drink where you pick two adjectives from a list they give you and let the bartender make you something. I chose fruity and refreshing (with a request for minimal alcohol because I’m not in my 20s any longer) and the bartender nailed it in a pretty pink and refreshing drink.
If you have a larger group, you can get big group drinks like “We’re Gonna Need a Bigger Boat.” Good luck.
The food we tried was delicious. We tested out battered chicken, French fries, and churros. Yum. They have a full bar menu of dishes like burgers, shrimp bites, and all things battered with cheese. You don’t need a reservation to go eat or drink.
As you may expect, Group Therapy offers options for parties of any kind: birthday parties for kids and adults, corporate events, bachelor/bachelorette parties, and anything else you want to celebrate. You can email them via their website to get an exact quote of whatever you envision for your awesome party there.
To play games at Group Therapy, you need to make a reservation. They suggest you get there about 30 minutes before your reservation to make sure all the waivers are filled out and to grab some food and drink.
Kids are welcome to play at Group Therapy until 7 pm. After 7 pm, you must 21+ to enter.
Prices vary depending on which games you want to play. For example, axe throwing is $25/person per hour (wear closed-toed shoes). You can have food and drink delivered right to your bay. A round of miniature golf is $25/person, Ping Pong is $10/person, and Ice Curling is $20/person.
Group Therapy Pub & Playground is a lot of fun. It’s so easy to get into the wacky atmosphere, which allows you to just play and have a good time and take hilarious photos. The staff at Group Therapy were all so kind and helpful and seemed like they really enjoyed being there. I think anyone of any age will really enjoy the place and that it’s a great addition to downtown Greenville.
Hours are Sunday – Thursday from 11 am – 10 pm and Friday – Saturday from 11 am – 2 am.

$150 million investment will create 600 new jobs COLUMBIA, S.C. – ...
COLUMBIA, S.C. – Health Supply US, a leading government contracting and medical supply company, today announced plans to establish new manufacturing operations in Greenville County. The company is investing $150 million and creating 600 new jobs over the next five years.
A dedicated health care industry and government private sector partner, Health Supply US works to secure the United States’ domestic pipeline of medical supplies by identifying, sourcing and delivering personal protective equipment (PPE) for health care systems and federal, state and local governments. The company’s FDA-compliant products include Class I medical devices and products such as medical isolation gowns and nitrile gloves.
Located at 1 Quality Way adjacent to Beechtree Business Park, the Health Supply US Greenville County facility will operate as Glove One with a distinctive focus on the manufacturing of American-made nitrile gloves. The new state-of-the-art facility will produce an expected 4.3 billion nitrile gloves per year and greatly increase the domestic supply for this critical medical supply item – helping to protect America’s public health and national security.
The new medical device manufacturing facility is expected to be complete by January 2024 with local hiring to begin in 2022. Individuals interested in joining the Glove One team should visit the company’s website.
The Coordinating Council for Economic Development has approved job development credits related to this project. The council also awarded a $300,000 Set-Aside grant to Greenville County to assist with the costs of site preparation and building construction.

There’s a short track of the Saluda River that you can take your own tubes on for free via Dolly Cooper Park, not 15 minutes outside downtown Greenville, SC. We tried it out and have all the details for you!
When I heard about the new docks at Dolly Cooper Park in Greenville that opened up last year allowing guests to kayak or tube for free, I had to try it. It wasn’t until this heat wave though that I got over there with my kids and let me tell you, it was the perfect remedy for the 100-degree day we went.
Also, the big draws for this place are that it’s free, it involves water on hot days, and it’s easy on the gas tank being so close to Greenville.
The park, while having a Greenville address, is actually in Anderson County and just off I-85 near Easley. It has baseball fields, a disc golf course, and there is currently a ton of construction going on. It also has an ADA-accessible paved walkway along the Saluda River.
The park, while small, is the perfect launch point for some time on the Saluda River. The docks were unveiled in the summer of 2021 with the help of a $50,000 grant from Duke Energy.
There are two identical kayak launches in Dolly Cooper Park a quarter mile apart. When you park, drive past the construction on the gravel road and past the baseball field down to a paved parking lot. You’ll see the wooden walkway to the northern dock. That’s where you will want to put in your tubes.
Once you get in the river, you’ll tube for about 15-20 minutes, depending on how fast the current is and water level, down to the southern dock. Be sure to go to the right of the small rapids near the dock so you can grab a hold of the dock and get out of the water with your tube (see below for more tips on this maneuver!). Once out of the water, carry your tube back to the northern dock on a quarter-mile paved trail and do it again! It only took us maybe five minutes to walk back to the dock and we got in about three runs on the river before I decided I had to get home and make dinner!
The river is nice and wide and it was really calm when we went. It was very relaxing and enjoyable. And we saw some cute turtles.
It’s free. There is no cost to tube, park, or enter the park. And it’s just 15 minutes from Greenville.
There are a few things I think you should consider when tubing this stretch of the Saluda.
Thankfully, it’s pretty easy to find tubes in our area at places like Academy Sports, Dick’s Sporting Goods, and WalMart. I was using a cheap WalMart Ozark Trail tube while my kids used bigger river tubes that we had bought a couple years ago. Lifejackets can be picked at the same stores or try Facebook Marketplace – I’ve found some great deals on water sporting goods there.
Here are a few links to help you:
If you’d rather pay for tubing and a shuttle service, we’ve got a big list of places to go!
